Common Interest Community Terms

Association: includes condominium, cooperative, or property owners’ associations.               

CICB: Common Interest Community Board, which is a regulatory body created by statute under the Department of Professional and Occupational Regulation (DPOR).

Common Interest Community (“CIC”): real estate located within the Commonwealth subject to a declaration which contains lots, at least some of which are residential or occupied for recreational purposes, and common areas to which a person, by virtue of his ownership of a lot, is a member of an association and is obligated to pay assessments provided for in a declaration. 

Common Interest Community Manager: a person or business entity, including but not limited to a partnership, association, corporation, or limited liability company, who, for compensation or valuable consideration, provides management services to a common interest community. 

Condominium: real property, and any incidents thereto or interests therein, lawfully submitted to this chapter by the recordation of condominium instruments pursuant to the provisions of this chapter. No project shall be deemed a condominium within the meaning of this chapter unless the undivided interests in the common elements are vested in the unit owners. 

Cooperative: real estate owned by an association, each of the members of which is entitled, by virtue of his ownership interest in the association, to exclusive possession of a unit. 

Development: real property located within this Commonwealth subject to a declaration which contains both lots, at least some of which are residential or are occupied for recreational purposes, and common areas with respect to which any person, by virtue of ownership of a lot, is a member of an association and is obligated to pay assessments provided for in a declaration. 

DPOR: Department of Professional and Occupational Regulation. An executive branch agency responsible for regulating certain professions and occupations as determined by the General Assembly servicing more than 300,000 individuals and businesses across hundreds of license types, ranging from architects, contractors, landscape professionals and engineers to include CICs, management companies of CICs, and the Principals and Supervisory Employees of CIC management companies and the registration of condominium and timeshare projects and the resale of timeshares.

Master Association: an association with authority to collect assessments for the maintenance of common area and authority of sub associations which may/may not include use of personal property within the sub association.  

Property Owners’ Association (POA): an incorporated or unincorporated entity upon which responsibilities are imposed and to which authority is granted in the declaration. 

Professionally Managed:  a common interest community that has engaged (i) a common interest community manager to provide management services to the community,or; (ii) a person as an employee for compensation to provide management services to the community, other than a resident of the community who provides bookkeeping, billing, or recordkeeping services for that community.  

Sub Association: an association with its own authority and subject to a master association’s authority.
